Jay, I live in the same state as the poster. I have relatives in law enforcement and you are absolutely correct. An officer can "look" (not search) the car unless the driver gives their permission. They are not allowed to go through the car without a warrant that they have to get while the car is still beside the road or wherever they made the stop. The car cannot be moved if the officers are asking for a search warrant. Now, if they happen to see drugs, open containers, etc. just rolling around on the floors or seats of the vehicle, then that's a different story. The stories I could tell you, my son was a sheriff's deputy and he would stop someone for speeding and actually see the person tossing "whatever" out of the window but if "whatever" couldn't be found then the person would only be charged with speeding. I agree about drinking and driving, I still tell my grown sons if they are drinking and have no way home to call me any time of night and I will get in the car and pick them up, no questions asked. The DUI laws are tough, but I don't believe she will lose her vehicle since they usually let you drive with a provisional license for work, grocery stores, things that are necessary. I am not being snotty here, just curiuos.
Also, my attorney said the search is likely legal, since I opened my big mouth on the pills.
I also told the officer that I had an appt in 2 days to go into treatment.
His resposne: "I know, I found the paperwork."
He also said "I suppose the Doctors got you hooked"
I said "No, I got me hooked, it wasn't thier fault".
Then he said, "I brok my foot and was giving those drugs and never even took them. They are not necessary to control pain and are only for people like you, looking to get high".
(that may have not been word for word, but it was close)
Another officer laughed and agreed, He stated they should be written only for cancer patients.
Anyway...6 days Hydro free and I am feeling better and better!
This is the third day I was able to get out of bed w/o prodding. I don't know why, but when I was using hydro (at least after I went over 20-30 mgs daily....10 days ago I was using 200 mgs daily) I found it was almost imposssible to functioin in the am before I dosed. I hated opening my eyes in the A.M.
Now, despite my legal troubles, I look forward to getting up. Especailly if my kids haven't gotten up yet and I can enjoy a quiet cup of coffee.
