Jay, I live in the same state as the poster. I have relatives in law enforcement and you are absolutely correct. An officer can "look" (not search) the car unless the driver gives their permission. They are not allowed to go through the car without a warrant that they have to get while the car is still beside the road or wherever they made the stop. The car cannot be moved if the officers are asking for a search warrant. Now, if they happen to see drugs, open containers, etc. just rolling around on the floors or seats of the vehicle, then that's a different story. The stories I could tell you, my son was a sheriff's deputy and he would stop someone for speeding and actually see the person tossing "whatever" out of the window but if "whatever" couldn't be found then the person would only be charged with speeding. I agree about drinking and driving, I still tell my grown sons if they are drinking and have no way home to call me any time of night and I will get in the car and pick them up, no questions asked. The DUI laws are tough, but I don't believe she will lose her vehicle since they usually let you drive with a provisional license for work, grocery stores, things that are necessary.
