Yeah, but what no mentioned here and what I have seen happen often is the following:
You get pulled over for a minor traffic incident. For some reason, the cop has reason to believe you have pot in the car; he smells it, your eyes are bloodshot, you making movements to try to hide something when he came up to the car, you have a copy of High Times in the backseat, whatever.
He asks for permission to search. You refuse. Well, no offense but even the dumbest cop knows anyone who would refuse a search 90% of the time has something he doesnt want to be found. So, now the cops real suspicious. If its drugs, hell more likely call out the canine unit. Your screwed. Since that will definitely be held up as probably cause.
From my experience, if a cop wants to get you arrested, hell find a way. I know people that were arrested for having a few sheds of pot on the carpet in the back seat. If not, often they will plant it on you.
That is why it is all the more important to exercise your right to silence. Talking to the cops will NEVER help you despite how they try to make deals saying if your honest theyll go easier on you. Yeah, right. Dont believe it for a SECOND. That is how they try to trick you. If any deals are to be made its between the DA and your attorney.
Another tip: keep a clean car. The cop is a lot less likely to get suspicious if everythings tidy and in plain view.
