New Medical Privacy Rules Effective Monday

New national medical patient privacy rules, officially called the Health Insurance Portability and Accountability, "HIPPA" for short, will go into effect Monday.
HIPPA is the government's attempt to protect patient privacy at or in hospitals, nursing homes, home health agencies, pharmacies, doctors' offices, hospices and health plans.

Congress passed the bill in 1996, regulations were finalized last August and compliance is required by next Monday.

Teresa Zinck and husband Rodney have been in and out of University Hospital several times this year for her surgeries and she's accumulated a large file of medical records and worries that they'll stay private.

Not surprisingly, she likes what HIPPA does.

"I just think it's a good idea. I think that you should have the right to only let who you want to know your information," said Zinck.

"What HIPPA does is strike a balance between the information that people need to know and the information people want protected," Nancy Strassel, Vice President of the Greater Cincinnati Health Council.

Strassel has helped members implement the new program and she says the law stems from people concerned they would not get health insurance if they changed jobs.

"Obviously, those in the treatment field need to know, but beyond that HIPPA begins to ask questions about who really needs to have access to people's medical information," Strassel said.

Hospitals, for example, may be able to release some data, but it's limited to the patient's name, location within a facility, condition in general terms and for clergy only.

At the Health Point Medical Center in Bellevue, numerous records changes are being made.

Records cannot be kept where names can be read by unauthorized people, computer screens have to be shielded from people who don't need to know and signs are being posted in English and in Spanish.

"We're going to be locking up medical records at night more than we used to do so they won't be lying around on the counter where I suppose if somebody broke in they could see them," said Dr. Toby Acheson, Health Point Family Care Medical Director.

The new rules will restrict reporter access to information especially in breaking news situations.

For example, if a reporter was trying to determine the number and nature of injuries from an accident they have to know the name of a patient to get any information and any patient can ask that his or her name be left off a directory available to the public.

Thanks for the post Kathy. I had seen a sign on the counter at my pharmacy re: the law going into effect. The sign also mentioned that customers waiting around to pick up their prescriptions will be required to wait away from the "consultation area" as those receiving consultations have a need for privacy. Its nice to see a law enacted to protect patients.

I like the idea of medical privacy, but I work in a hospital, and I know that in reality it means nothing but a 5 page document that patients have to sign before receiving care. All we have to do is shred documents with patient info, and lock out files. But in reality, so many people in the hospital have access to the patients charts and info. I don't know if these rules are supposed to prevent identity theft or misuse of medical infomation, but I don't think it will stop docs and pharmacists from being nosy in regards to out prescription histories. Hell, the insurance companies know every time you go to the doc, what for, what you are prescribed. To me, HIPPA is a nice idea in theory, but I think that it is just the Governments way of trying to show that they care about our privacy. It still won't stop the DEA and insurance companies from telling physicians how to practice medicine. I wonder if these rules will affect OP's in any way? Any ideas?

Here is the site for all of the info on this HIPPA...I had to sign this paper a couple monthis ago at my PMD office to get my meds...he told me that this is not only for insurance but for the cops, feds and for other doctors to look into your records, its also very quick..they now use the EDI system.....boo

I went to the Dentist office yesterday and they wanted me to sign a paper saying that if my Doctor wanted my records He could have them I didn't sign!! Sara

I read the little BOOKLET my DR. gave me the other day about NEW PRIVACY PRACTICES. I think people who DOUBLE-DIP (HAVE TWO DOCTORS GIVING SAME OR ALIKE MEDS.) ARE GOING TO GET CAUGHT REALLY EASY! (NOT THAT I DO-IT ) I JUST THINK IT TAKES AWAY SOME PRIVACY? WELL THAT'S JUST ME! GOOD LUCK, CHEESE

Good for you...this is your right...you keep it that way...it's hard for me because I HAD to sign my PMD's because he wouldn't give me my meds...I am very worried about ordering online...not sure ofall of the implacations on the rules in Florida...if they don't have to report then I am ok....if not...I guess I am in trouble...boo

What is going to make it so much easier for them to catch doctor shoppers under this new system, which I still don't quite understand quite yet. Just curious. I hate to see the erosion of privacy, especially when it comes under the guise of providing more privacy.

ANYONE KNOW THE ANSWER TO THIS? I LIVE IN ONE OF THE STATES THAT HAS A COMPUTERIZED DRUG PROGRAM. IF ANYONE KNOWS PLEASE IM ME, I DON'T UNDERSTAND THE LAW.

I wonder with this new policy, If that is why my Doc won't give any pain releaf (sp), but He tries to give me T'3 which I can't eat makes me sick! I wonder if the Doc can go on line and look and see if you are getting them on line. Does anyone know??

My doctor has this "booklet" hanging in his office and I haven't had to sign anything yet...knock on wood, but I don't think he really cares about these things one way or the other. I honestly think that if he did have a way to look this stuff up (our OP usage) he wouldn't take the time to do it, or even have his secretaries do it. I know him outside of his practice and he is a very laid back guy...a little on the "goofy" side . He can really frustrate me to no end at times (he refuses to give out narcotics unless someone is DYING!) but overall he is a great guy and I think he is very concerned about people's privacy...that's why I have stayed with him this long.

The way I see it is that the monitoring from state to state will be done through insurance right now..I am not sure about oniine...but if you have to use your insurance to go see three different doc's and they prescribe the same thing for the same problem then that is called doctor shopping and they will catch it...my insurance wich is pretty good..BCBS-ppo..are a bunch of jerks...a couple weeks ago my doc gave me a script for Xanax...the bottle clearly stated take one on onset for anxity...so when I went to refill it the insurance would not cover it...too early...so I just paid for it myself..lucky that gen-Xanax $13..so go figure..but I think that for now this is the why they are doing this...now don't take me at my word here ..this is just the way I see it...I still have never gotten an answer to the queston about FL and if they HAVE to report to this monitoring system..they are not in the monitor state..so it stands to reason no..JMO...BOO

ps...at my pharmacy now you have to stand behind the red line till the patiant in front of you is finished..they say so that you can not hear what they are saying...

While I am not sure of this but reading the papers it's for insurance to look for doc/shoppers and to give the authority to doc's to talk to other doc's about your illness, see your records...also if the doc gets audited by the DEA then they can look into your records as well...this is not a good thing..but this was told to me by my PMD and the whole thing is very convalooding so wether that is what he got out of it who knows..also for insurance fraud..and bosses that don't hire you from past illnesses can not look at your records. I am very worried about Florida..the NASPAR thing might just happen and then we are all out of our refills....lets just hope that the doc's win this one in that state...but this stop and shop on the ERXonline thing would make sence then...boo
