Offences

Possession
'Possession' means the smallest measurable trace, whether or not it is sufficient to cause a whisper of intoxication. In each case of alleged possession the prosecution must prove 3 major points:
- that the substance was in the defendant's possession or control
- that it is a controlled drug
- that the defendant knew s/he possessed the drug

Supply
Charges for the supply of a controlled substance are the following:

Possession with Intent to Supply
The amount in question is not relevant and it is possible that a small gift to a friend will render a person liable to this charge. A large amount for personal use might well be construed as proof of intent to supply, as might a smaller amount of say, amphetamine sulphate, that has been divided into several wraps.

Offering to Supply a Controlled Drug
The offence is complete once an offer is made, whether or not it is accepted. The prosecution can even succeed if the material turns out not to be a controlled drug.

Supply/Producing a Controlled Drug
If one person buys on behalf of a group then this amounts to supplying. Cultivation of cannabis rates as production.

Supply of Steroids
In November 94 this new offence under the Misuse of Drugs Act was introduced. The penalties are the same as that for supplying a Class B controlled substance.

 

Sections and Maximum Penalties

Class A
Common substances:
Cocaine, crack, heroin (diamorphine), LSD, ecstasy, morphine, opium, psilocin (as found in 'magic mushrooms'), cannabis oil

Less common substances:
Cocoa leaf, dextromoramide (e.g. Palfium), dipipanone, fentanyl, mescaline, methadone, pethidine, PCP, all parts of the seeds of the opium poppy (after mowing), DMT

Maximum Penalties:
Possession (Magistrates Court) 6 months/5,000 pounds sterling fine or both
Possession (Crown Court) 7 years/unlimited fine or both
Supply (Magistrates Court) 6 months/5,000 pounds sterling fine or both
Supply (Crown Court) life/unlimited fine or both

Class B
Common substances:
Amphetamine, barbiturates, cannabis and cannabis resin (inc. herbal cannabis). Less common substances:
Codeine, dexamphetamine, dihydrocodeine (DF-118), methaqualone, methylamphetamine, methylphenidate (Ritalin), phenmet-razine (Filon),

Class B drugs become Class A when prepared for injection.

Maximum Penalties:
Possession (Magistrates Court) 3 months/2,5000 pounds sterling fine or both
Possession (Crown Court) 5 years/unlimited fine or both
Supply (Magistrates Court) 6 months/5,000 pounds sterling fine or both
Supply (Crown Court) 14 years/unlimited fine or both

Class C
Benzodiazepine tranquillisers, (e.g. Temazepam), dextropropoxyphene (Distalgesic, Doloxene) plus other mild amphetamine type stimulants

Maximum Penalties:
Possession (Magistrates Court) 3 months/200 pounds sterling fine or both
Possession (Crown Court) 2 years/unlimited fine or both
Supply (Magistrates Court) 3 months/500 pounds sterling fine or both
Supply (Crown Court) 5 years/unlimited fine or both
