I would love to and I appreciate people who have the sense to put their email into a proverbial envelope. The Sewer Department CAN invoke national security - almost every county and city agency has a representative for the Homeland Security Project now, and can leverage FEMA and/or the Patriot Act to their advantage, IF FEMA feel the situation to be worthy. This isn't new at all, it is just more significant now than ever. All those countywide GIS projects that local governments have been spending millions on are now the domain of the county's Homeland Security representative.
Like I said, I was exaggerating for humor value, but they can certainly do it - even the electric company here have stickers on their trucks explaining that they are the eyes of the law and report anything out of the ordinary.
Oh as far as monitoring internet conversation, its easily avoided. The LEO technology used to monitor email and forum posting is called DCS-1000 (look it up) and is placed at major backbones, so your ISP doesn't have anything to do with it. And like PSTN (telephone) conversations going through digital switches (usually ESS5s) they can be scanned for digital keywords.
Also for the record, the Supreme Court ruled many years ago that there is no constitutional guarantees of privacy at all, so any lesser courts agreeing with them over email privacy is rhetorical - privacy is already NOT specifically guaranteed, so their ruling would be irrelevent.
