Last week Richard Paey, a Florida man who suffers from terrible back pain as a result of a car accident and unsuccessful surgery, received a 25-year mandatory minimum sentence for drug trafficking. After moving from New Jersey to Florida 10 years ago, Paey could not find a local doctor willing to prescribe the large amounts of opioids he needed to relieve his pain, so he started filling out blank prescription forms he obtained from his New Jersey doctor. Although these prescriptions led to drug trafficking charges, there is no evidence that Paey used the drugs for anything other than his own pain relief.
I DO NOT GET THIS. Why would someone be charged a "DRUG DEALER" when the prosecutor just said he wasn't? Why didn't they charge him (if appropriate) under the laws they are trying to convict Limbaugh under--"doctor shopping to obtain narcotics?" Or at least something like fraudulently obtaining medications?
And that Best if kept off the board about the jury foreman--wow! What makes that person think it's OK to hand out legal advice to the rest of the jury? I can't fathom that he'd even THINK of presuming to predict what this man's sentence would be. Now this man's life is ruined.
I can tell you I am one stubborn girl and there's no way in heck I'd ever vote for anything other than the facts. That coercion we sometime hear about in jury rooms wouldn't happen more than once. I'd be screamin to the judge about those little "threats from another member(s)."
Sorry about the rant, but it just infuriates me to see how our legal system doesn't work in this country. Betcha' Limbaugh won't go through this--he's rich and influentual
Peace,
