I won against the bad dentist

I had to make a trip to our State Capitol which is 4 hours away to testify in a hearing against a dentist who hurt me
very badly and who ruined two teeth. I later had to be put to sleep and have the drills he left in dug out and the teeth pulled.

I went before a panel of 6 men, one an attorney. The State Board of Dentistry awarded me a small settlement, fined the dentist, and they made him go back to school. So, if you feel helpless, and you really want to pursue malpractice - it can be done, even without a lawyer.

There was another case against this dentist after mine where it was claimed he got a minor hooked on Vicoden. I never heard how that turned out.

I think it is rude to ask someone how much they got from a malpractice suit against a (yuckkkk) bad dentist.Could not pay me enough money for anguish and pain!

naahhh, I dont think its rude to ask. He voluntarily came out and told people about this. Its only natural to wonder how much he got. (I won the powerball.yeaaaa!!!!!) Do you wonder how much? Sorry- just my 2 cents.

I tell people all the time I won against work comp and the city whose sidwalk was messed up that I fell on but I would never tell anyone unless its family how much I won. That may be just me but at first I did want to shout it from the roof tops that I did win against the horrible work comp system in this country. If you do have a suit against work comp and have struggled thru all the "starving out" tactics they use, anyone would want to say "NANNY NANNY BOO BOO" to the work comp system and tell anyone who is going thru it, Somehow someway, you can get thru this. I was lucky to have had a good support system (and a hubby who worked 7 days a week) to get thru this but once you win, You want everyone to know you won, just maybe not the amount you won. Again, my .02 and not meant to offend anyone. I seem to do that with the most innocent of posts recently.

Not trying to be terribly picky but - better to say "awarded" as in "I was awarded a settlement amount".

"I won XX dollars" makes it sound like you were on a game show -

I agree it's in bad taste to ask how much one was awarded. Makes it sound like "hey I might do that too if there is enough cash in it for me".

So true,it does sound tacky to say I won, or that I kicked their patootie in court.

I was awarded XX dollars from work comp (actually the state I live in took over the claim cuz work comp company went belly up) and then I won XX dollars against the city I was working in because they had been warned many times about a tract of sidewalk that had caused many people to fall before and never did anything about it (that is until after I sued)

So XX Dollars
Plus XX Dollars

My experience here locally with people that I know personally to have "won" a W/C case was that to them, it was like a game show since it was a big fraud anyway. One man won abbout 4 or 5 settlements from different employers for the mere fact that he could.

W/C is a joke for the most part, except for those who were truly injured to the extend that they could not work and needed long term rehab.

Well its either a joke to one extreme or the other. The ones who truly need their help are "starved out" with the ruthless work comp tactics that make you go CRAZY. Its a horrible nightmare if you are truly hurt and cannot get work comp to lift a finger to do anything until you hire an attorney and then its still a long long uphill battle. Took 4 years to settle my case and I deserved every penny plus alot more but I got what I wanted which was for them to take care of my back pain/doc/meds the rest of my life. I wouldent settle until I was sure of that. I had read many stories online where people took the first or second settlement offer cuz work comp hadnt paid them for being off work because they had to prove they were hurt to their satisfaction and it will NEVER be to their satisfaction. So they take the first little amount dangled out in front of them because they are probably fixing to lose their house, cars, family, sanity and then are stuck STILL witht he injury that started it all and once you sign the settlement, theres no going back. So I said NO, NO, NO. I will take XX amount of money and work comp has to pay for the care and treatment of my back pain including meds. Finally the day before it was to go to court, they agreed and TADAA!! They could of done it years before but were waiting to see if they could starve me out until the court date. When they realized I wasnt gonna budge, they settled. The few people who claim to be hurt who are really not hurt make it so hard for the people who really are hurt.

about that.

I'm telling you - that dentist groveled so low, he
was under the table. The Board threatened appeals
court if he did not accept their fine and settlement.
Of course, he agreed.

Yes if you did not sign away your right to sue him, you can sue him and you should. Sounds like yall might have a class action case in Fed Court if enough of his former clients sign up. You should contact an attorney Monday morning first thing and find out your rights.

Thanks - I wish I knew who to call. Boy, do I have someone who could dish out all the bad news on this dentist. A former employee I ran across who works for the oral surgeon I went to. She told me he had already had several complaints filed against him. Plus I know someone else who had a bad experience with him! Hmmmm.

Go to the Bar association for your state and either look on there for or call them and ask them to refer you to a good plaintiff's/dentist malpractice attorney. They should be able to tell you real quick whom they would use. Thats how I found my attorney, I asked the lady who answered the phone who was giving me tons of names, I said "if you were me, who would you call?" and she told me and man I had me a Tiger!!!

i think denistry is a tough field, but that does not give a reason to be incompetent...i had a friend who photo copied her scripts and went to multiple pharmicies from a dentist..the scripts were computer printer and she went to some many pharmacies that i think she lost track....it is so much easier online

My goodness Bsura22, your friend has some guts doing that. If I can ask, did LE or anyone find out? If not, how long has it been?

My old pain doc used computer generated scripts but he gave plenty of meds so I never would have tought to do that, but it does make me think that its very sad what some people will do sometimes to get adequate pain refief. If her need was legitimite or not, she is running a very high risk doing that. She could lose her freedom. If she took it to many pharmacies, then I bet if she were ever caught, each copy/script filled would be a felony and she would be in a lot of trouble.

Did you share with her about your online experiences with OP's. I know her way may be easier on the pocketbook but plead with her to think about what will happen if she gets caught. Many states have databases and sooner or later if dentist/pharmacy or local LE doesnt get her, the state might thru their database. Not sure if your state has one but most do now.
