I found an old undated prescription for hydro with 1 refill.
My pharmacy will see that I had a script for the same med from the same doc about 2 years ago. If the pharmacy calls to verify the script, the doc will say that I haven't seen him in awhile. I have a legit pain need that stems from the same reason I got the script in the first place.
I have two questions mainly:
1. Is it legal to get this script filled?
2. How should I fill this script? (my regular pharmacy, different pharmacy, time of day, etc.)
Any comments, suggestions, or otherwise are appreciated. THANKS

to answer your questions...
1. sorry, you cannot legally fill it. strange that your doctor never bothered to date it. no pharmacy will fill an undated script. they wouldn't be able to tell when it expired. and if your script is 2 years one then it has long been expired, EVEN if it is undated. and you absolutely cannot modify a prescription and that means writing ANYTHING on it, including filling in a date. if they call your doctor or you are otherwise caught, you can get into big legal trouble and even after you have paid your dues, you may be tagged as a "drug-seeker" which will make it very difficult for you to obtain narcotic pain meds in the future, no matter how legitimate the need. don't do it. please take my advice and just trash the script.
2. not applicable. do not fill!

Maybe, if you are able you can go back to the same Doc, and being that it is the same problem, he'll just write you another script. Hope you feel better and Good Luck.

I agree. I had a friend who did that and got in BIIIG trouble. She was tagged as a drug seeker and was totally horrified. Call your doc! Just say you found the old script and never had it filled and could you please have a new one.

The script is only for like 12 pills or something like that. Thats not much but I guess I was excited because of the prices of these NROP's i've been paying.
From then til now my life has gone down the crapper and I no longer have health insurance to afford to go see doctors.
I was going to ramble on with this message but if everyone here agrees that it is a bad idea to try to get this filled, I might as well put the script through the shredder now so I don't do anything stupid.

Actually it depends on your state. If it was a legitimate prescription and you never filled it, its not prescription fraud. Its just a question of if your state has an expiration time and if they require a date. I'm pretty sure most states will not let you legally fill this... but, check your local regulations. If in doubt call a lawyer or a sympathetic pharmacist.

And just to be clear, DO NOT alter it by adding a date, that WOULD constitute prescription fraud. And do not try filling it before researching the legality.

Can you believe this? In my state, it's actually a LAW that the pharmacy has to return the old bottles, intact, to the consumer. So, a person could have all kinds of bottles with X number of refills remaining. Is this really stupid or what?
This is the same state that, by act of congress, rounded the value of PI to exactly 3.

Actually I think what you may be referring to is part of the HIPPA law wherein anything that has your name on it they must return/give to you, with the exception, obviously of the paper prescription you take to them from your Dr. And your # of fills is going to be in the computer system, so it won't go off of the bottle anyway.
Since I always got the same RX's each month, I always had them throw away the information sheets, when HIPPA was enforced they said they had to give them to me now and that I had to be the one to dispose of them since they too had my name and address and Dr.'s name on them, but after a couple of months, I got them to just do the shredding right there at the pharmacy for me.

Well just an update...I did bite the bullet and go have it filled. No problems at all! Not even a wierd look or any questions.
They gave me mallies though, which I've never had, and don't really like. They seemed to take forever to work but they did eventually at full strength.
I paid $5.99 for my little 12 pills which I thought was crazy considering I just had 40 stronger pills filled for less than $13.00! BUT, I didn't say anything and was thinking about the $3/pill prices that NROP charges all the way out to my car.

They didn't care about having no date! Didn't even mention anything about it.
I did think about writing in a date at first but then I figured that I wouldn't have any way to play dumb that I didn't know I couldn't fill it. So I left it as-is and had no problems!
We don't really have a prescription abuse problem here in the midwest I don't think compared to other parts of the country. Maybe that is why I had no problems.
I'm also curious...does anyone else ever have to show an ID when picking up controlled meds? I've never once seen anyone IDed as long as you can verify the address they have in the system. Except a friend of mine did just ask them to change the address since he moved and they didn't bat an eye either!

Amazing that everyone here told you that this would be a mistake and you said it was going into the shredder - but now you've gotten away with it and for a measly #12 and you'll think it's okay next time because you got away with it this time, but *next time* you may take an even bigger risk without the same results.

Yes, I have to show an ID to pick up percocet and that's with a pharmacy that knows me very well. I remember going to pick them up one night and I had fogotten my license at home but figured..."oh, they know me. It won't be a problem. I get this filled every month." Wrong! I had to drive all the way home to get my license. I was kinda of mad about it. I understand the practice of asking for a picture ID to pick up a narcotic but when you KNOW the person and they come every month... Oh well, now I make sure I have my ID on me at all times.

Just realize YOU GOT LUCKY! You just put yourself at risk for being arrested and depending on your past record, put on probation or in jail. This is not a recommended way of getting medication.

The only folks more anal about dispensing meds than doctors are pharms. Of course, this one lies on you, fda. I bet you wouldn't do it again, but go ahead and enjoy. You earned them.

I am really bumming...A friend of my girlfriends left her Darvocet bottle at our business. She has givin my girlfriend these once and awhile when she asked for them. When I had seen them, and they sat for two days, I took a few. After a few more days I took the rest of them.
This gets worse. The bottle had two refills, I felt bad abou taking them , so I called the automated pharmacy line for a refill to replace them. I asked for the prescription, I am male, she is female. The pharmacy didn't ask for an ID, or anyhitng, and gave them to me. I didn't lie and say that I was her, or anything, but needless to say, I took the rest of that refill. There was one more refill left so I refilled it again. There was no problem getting them.
Here is were it makes me sick to my stomach. I was called by my girlfriend saying her friend went to the police . They have me on video at the pharmacy getting the meds. She told them I stole the meds form her. I know the police are looking for me, came to the house twice, I haven't spoke to them, to freaked. I have two sons, I have full custody of them. I have been under a lot of pressure the last few months, and I guess the darvocets made me feel better, and I that this person gave meds to my girlfriend, and didn't really care about them, thats why she left them????????! I know I shouldn't of refilled the prescriptions , but as I stated, I didn't lie to the pharmacy about anything.
I know what I did was totally dumb, and I am contemplating possibly going to Dr. or rehab, claiming addiction, before police get me?
I guess I am looking for some advice, I have been so bummed out , it is like a bad dream. I did not abuse Darvocets before, never cared for them, I guess they just "felt " good and the stress was eliviated and I felt better. Now I am stressed out more, and made things worse. I feel terrible. Wold the rehab idea be a better option? I don't know, I am not looking for sympathy, I messed up, I suppose if anytthing, I hope someone reads this who may run into this situation, and NOT DO WHAT I DID. BUt any help or ideas would be great.

You could try using this scrip with NHRG. Tell them honestly that it is old, but that the symptoms for which it was RX'd have recurred. Be honest, it might work but you'd have to pay another consult fee. Yet at least the NHRG doc will know you have been RX'd this before.

I am a bit confused.. you said she gave them to your girlfriend, right? If so, that's illegal too. How does your girlfriend feel about all this? Is she mad at you or mad at her friend for calling the police on you, or both? I was just thinking that if it's over now between you and your girlfriend...you might mention to her that her friend could be charged with some serious stuff too! Then pay her back her meds or whatever it takes to make things right with her. Maybe she could drop the charges on you? This is a tough one so You'd better get a lawyer quick!! It's probably a long shot and you DEFINITELY SHOULD NOT HAVE STOLE THOSE MEDS.... but an atty needs to advise you at this point. He will know if you should go to rehab first to soften the charges. I feel for you....I'm ASHAMED TO ADMIT THIS BUT I can picture myself doing that SAME THING, a few years back when I was going thru a bunch of [censored] and taking too many pills. Good luck-Hope

First asap contact a criminal defense attorney. He will advise you on what steps to take. Maybe you do need help. From a dr or therapist. The attorney will know what action you need to follow first.. GOOD LUCK !!!!

I really hate to say this but Iam afraid you are in trouble, the friend will not admitt giving them to your girl friend or she will get in trouble so its her word against yours and they have you on tape getting them, If you can get them to belive you that she gave them too you them you BOTH will get in trouble not just you, just calm down, You probely will be put in jail, but you will have a bond, I wish I could tell you more I just know about my experiences.............M

I was just thinking about that my pharmacy is so lax that they don't care who picks up a prescription for what. I've thought about doing what you did but don't think I could ever bring myself to do that just because it is guaranteed the heat will be on you when whoever comes in to fill their script.
In your case, I would definatly bring the girl who gave you the script down. Other than that, not much else I can tell you as I'm not qualified as an attorney or anything. You DO need legal advise. Please keep us updated on how things go.
As for my case, it was strage--when I posed this question, everyone who responded online didn't like the idea and everyone I asked offline thought there would be no problem.
I wasn't going to lie, if they called the doc and said it was no good, I didn't think I could really get in trouble because the script came from the doc. If they asked if it was old, I would say yes. If they asked why I didn't go to the doc again, I would tell them truthfully that I couldn't afford it. And if it came to it, some doc would verify my need for the meds in the first place!
I didn't modify it so I figured I could talk my way out of whatever I needed to. I do have a refill and I plan to get it filled, but I won't do this again. Why--because it's not likely I will ever be in the same situation. I don't have health insurance so I'd never get a script from a docal doc anyway.

fdafda, I wasnt saying anything about what you did IT WAS your script, its just when you mentioned about adding a date or changing it, that is the only thing I was talking about NOT doing!!!!!. I might of tried to fill it too if I was needing them, I dont know.....I was just saying do not add or change any of the writing on the prescription!!!!!!

Get your [censored] a lawyer- NOW!!! Follow his or her advise.
You do need treatment, but you need legal advise PRONTO!!!
If this is a first offense it may cost you some money and a 5 year probation, but you will NOT be going to prison...

As several people have stated the first step is to get yourself a lawyer. Don't turn yourself in without an atty. you'll sit in jail longer while you are processed. There is no avoiding being processd and spending several hours in your county jail. A lawyer can speed things up.
My girlfreind works for a doctor and a patient some how stole an rx pad and eventually got caught writing rx's for himself. This guy was forging illegal prescriptions and he got probation. Apparently this guy also had prior convictions for the same offense. Point being I don't think your in serious trouble, all though the biggest fear we have is fear of the un-known. Step 2 get youself some treatment. Not only so it looks better in the courts eyes but for the sake of yourself and your kids. Try not to stress and don't run into the police without a plan! 1) What you did was screwed up. You stole someone's medication. You should think about that, and consider getting some kind of help, as you obviously have a drug problem. I'm not trying to be mean, just trying to make sure you realize the seriousness of what you did and what that says about your current drug habit. It doesnt sound like you have any regrets about stealing someone's medication (just because you THINK she didnt care... well obviously she did, and since they were prescribed to her, obviously she had a medical need). All you seem to regret is being caught. You might want to think about that.
2) You just posted a confession to a public forum. I hope for your sake that your posts do not find their way into the hands of the prosecutor. Too late to take it back now, but you should be careful who you admit things to until after this has gone to court. Anything you say can be used against you in a court of law, etc.
3) You need to call a lawyer. And then, you will probably need to turn yourself in. This isnt going to go away. Your best bet is to get legal help and to get yourself into a treatment program. Not only will a treatment program look good to the court, but if you're stealing drugs and are too far gone to think you'll get away with trying to fill someone else's prescription who has a female name... you really need help. In any case, you really have no choice but to face the music. Get a lawyer and turn yourself in. Your girlfriend's friend can't un-file charges. Sure, giving her prescription to your girlfriend is illegal, but theyre not likely to make a big deal of that. They will make a big deal out of what you did, however. You will almost certainly get put in court ordered rehab (which you probably need) and probation is very likely. If you have a prior record, you could go to jail for a little.
