I posted occasionally a year or so back with questions regarding "Physician Abandonment" on the DB board. To make a very long story short, I had ten surgeries from January /01 to March / 03 for breast cancer reconstruction.
The surgeries also involved two infections: of one of the implants and MRSA, as a result of a TRAM flap procedure. So, today, my chest looks like several railroad tracks run every which way AND one side goes to my WAIST and the other side is very tiny.
My abdomen has more than the expected scar from the TRAM. I have a huge scar from the MRSA infection and NO belly button!
I have found another surgeon who is going to attempt to fix me, i.e. to make both sides match, as mother nature intended and fix my abdomen.
At first, I was reluctant to even CONSIDER suing, because I have never been involved in a lawsuit, but when he stopped returning my calls and cut me off pain meds IN THE MIDDLE of a surgical recovery, I had a change of heart.
Today, I'm considering a lawsuit for all the pain, anguish and unnecessary procedures that I underwent, while in his care.
My question, are any of you all familiar with what it takes to sue a physician? How does one find an attorney?
I don't know where to start. Also, the surgeries were done in a neighboring state. Your help is appreciated!
BTW, I don't want a zillion dollars; I simply want enough money to cover what my insurance does not cover.
I have omitted LOTS of other issues here, but there isn't the space for all of it.
Once a malpractice attorney looks at your case,he will determine if first, you have a good enough case and second if he can win enough to cover the cost of trying the case, his take and what you will eventually recover in the end. Malpractice cases can be very expensive to try. Especially if they have to call in expert witnesses and such. I learned this when a work doc gave me a shot of cortisone in my elbow in the wrong area and it ate away the whole fat pad and left me with nothing but bone. I wound up having to have surgery and the radial head removed and lost 30% use of my right arm. I took it to a lawyer and he said there wouldn't be enough recovery money in the case for it to be cost effective. I hope you have a different outcome. Good luck!
After a botched rotator cuff surgery,I was told the same thing as the previous poster. In my case it would involve expert witnesses and that cost lots o money.Dr's will cover each other thus the experts would have to come from out of the area creating more expense. In a nut shell I was told I could put up major and I mean MAJOR $$$$$$ and then we could roll the dice.Every case is different so the best thing is to find an attorney and let them look at the case.Make sure he doesn't represent or do any work for any of the parties involved.Good Luck....P
