I've been reading lots of posts and I am confused as to whether OP's can still use pharmacies to fill their prescriptions through a Florida pharmacy.It sounds like FL based OP's are gone or going. No particular reason to know, just curious. Does anyone know?

Hi Booker,
I don't know about EVERY pharmacy in Florida - but I know that United is still up and running - and I think that many others are as well. The ones that went under were the ones that were affiliated with the ops that did not require anything (not even medical records). There are still many Florida based ops up and running - however most do require records. Florida is still the location for the majority of the ops. I hope this helps.

I'm confused as well. Sounds to me like the new law requires that any doctor in Florida has to see their patient in a face to face before they can prescribe - thus the problem with Midland right now. Their OP is actually based in Nevada, but their doctor was in Florida (who was pressured by the DEA and quit) and their pharmacies are also in Florida. Can anybody shed some light on this?

Hi Everyone,
What's going on in Florida is a "resolution" not a law. Depending on how 'dangerously' a doc wants to operate, they can choose to ignore the resolution of their board, or they can honor it. It seems that the doc at Midland chose to honor it - but other docs, such as those at Tri-County, Kenaday, etc. etc, are ignoring it - at least for right now.

The following quote is from the Prevention Magazine article listed in the News and Media section - it should explain things:

"... some states and boards are starting to crack down. Nevada, for example, recently adopted a law making all e-consultations illegal. In Florida, the state medical board just implemented a resolution mandating that all state doctors have a face-to-face examination with their patients."

Thanks for the clarification gottadoit! I called Midland a few weeks ago to find out what there requirements were for a consult. At that time the young lady I spoke to A.... referred to it as " the law they just passed in Florida". So I think there is confusion all around. turcica

The Florida Board resolution which was printed here a few months back required a physical examination. The only "face to face" absolute requirement was for weight loss products.
No where did it mandate that the physical exam had to be done by the prescribing doc.
Since third party extenders (ie nurse practitioners, or P.A's)
are allowed by law, they would be hard pressed to make "face to face" an obligation. You can't have it both ways.
For now Florida only has administrative recommendations but no legislative rules as far as I know.
Does any one have any other knowledge?

Do we have any members that live in the "Sunshine State"? One of my friends lives in the Tampa area and I asked her to play detective. As you all know - this has been in the newpapers down there alot - thank you to buymeds, tropical, etc! She read a bunch of stuff and from what she found out - it is exactly as Prevention Magazine presented it - it is a Medical Board RECOMMENDATION - NOT A LAW.

Most docs will honor the recommendation of their board because they do not want to be disciplined or go thru any professional misconduct proceedings. However, they are NOT bound by any law at this time.

It's probably on it's way to becoming law - but that takes time. It has to go thru several levels of debate, committees and government before the governor signs it into law or vetos it. Knowing Brother Jeb - he'll sign it. I wouldn't worry about it right now - the ops in Florida are making way too much money and that law - if it ever comes - is sometime in the future!

what im about to say is only hearsay--- i talked with a
C.S.REP from a florida op and they said you cant order from
there op if you live in florida??
is that true?? people who live in florida cant use ops??

I can confirm that this is not true. No problem getting med's in Florida as of right now.
