i am just echoing what others have said, but if a licensed physician writes you a prescription that is then filled by a licensed pharmacy, then what could you possibly be prosecuted for? The doc is perhaps another story.
I know that some states have doctor shopping and double dipping laws, but i really believe that if anyone is going to get in legal trouble based on a US OP transaction it is going to be the doctor, not the patient.
I will share a personal story, though I would not suggest that anyone else follow this course of action...
About two months after 9/11 I ordered from a foreign OP for the first and last time. About a week after i placed my order, I found out that the OP i had ordered from was shipping from pakistan, and I totally freaked out.
I became convinced that the feds were going to show up at my door and haul me off to jail. After about a week of paranoia, I had an epiphany of sorts. I have medical records that document an observable condition (displaced lumbar in my lower back). This condition, when bad, makes it nearly impossible to do my job (software design). Finaly, I live in Texas, which most people think of a pretty strict law&order type of place. While this is tue, many Texans have become very uncomfortable with government intrusion upon the rights of the individual since we were forced to watch the Koresh debacle in Waco. Even those who thought he needed to go to jail, and i certainly did, could not believe the incompetent arrogance shown by the feds. Lastly, and sadly still true, Texas juries do not have a history of prosecuting my "profile type": a reasonably well-off white male without a criminal record who can immediately slip back into the south texas accent that i fought so hard to overcome while going to college is Washington. I was absolutely ready to go in front of a jury and say, "yep. i ordered this codeine, which by the way can be bought over the counter in every civillized country. Did I know it was illiegal? more or less. So why did I do it? So tht i could continue to function at work and pay my taxes that make up part of this schmuck DA's salary. So you folks send me to jail if you want. But remember, that if you ever develop diabetese, god forbid, you might as well not even look on the web and see that you can order your meds from Canada and pay half the price as here in the sates. Because if you were to do so, by your decision here today, you will instantly become a criminal, not to mention a hypocrite.
i worked myself up into such a lather that i was actually disappointed when my meds arrived uneventfully.
Sorry for the long ramble. All i am really trying to say is that instead of getting scared, get mad.
Get mad that the US government has declared a war on drugs that now seems to include prescriptions, yet nicotine, which some have claimed is more addictive than heroin, can be bought at every convienence store in the country, and that alcohol is so omnipresent in our society that i sometimes feel uncomfortable about the fact that i do not drink.
Finaly, get mad that for whatever reason you are unable to get the medical care that you need, and you have been driven to the web to research and treat your own condition.
I find it is very hard to be frightened when i am really angry.
Sorry this turned into a novella,
