Florida Legislature Sets Prescription Tracking Program Aside

May 11, 2003 - Proposed prescription tracking legislation died in the final moments of the Florida legislative session earlier this month, leaving in question the future of the program and of the $2 million that Purdue Pharma has pledged toward funding it.
The bill would have created a program to track prescriptions for Schedule II, III and IV medications, which include many pain and psychiatric drugs. Supporters say a tracking program would prevent prescription drug overdose deaths, but others have expressed concern that allowing investigators to track doctors prescribing practices so easily would have a chilling effect on legitimate medical treatment. In the last moments of the Senate session, opponents tacked on several unrelated amendments, dooming passage of the bill.
Purdue Pharma, the Connecticut-based manufacturer of OxyContin, pledged $2 million toward financing a tracking program last year as part of an agreement with the Florida Attorney Generals office to end an investigation into the companys marketing practices. Under the terms of the settlement agreement, if the state has not enacted legislation to create the tracking program by July 1, 2004, Purdue Pharmas pledge of $2 million will be withdrawn. If that happens, the companys obligation will be limited to a $500,000 pledge toward drug abuse education.
This is the second year that Florida legislators have considered and declined to pass legislation on the program. The Orlando Sentinel Tribune reports that the bills sponsors hope that Governor Bush will ask the legislature to reconsider it in a special session.
