It would seem that brittlauren has reasonable cause for action against NWW if her privacy has been breeched. It is my understanding that HIPPA laws apply to OP's as well.
I simply could not and would not stand by if I was certian and had proof that my medical history had been discussed in any way by a mod, employee etc. Am I wrong or is it fact that only the Dr and or PA should have access to your records? Then again, I just had a thought. When NWW lost my records for the 5th time (yes FIVE TIMES I had to re-send on a 8 month period)it was always a customer service person who would tell me they didn't have my records, then I would spend several days getting through to their fax machine, calling back everytime (rarely getting through by phone) and then a CSR would tell me they had the records and on 3 occassions I was told they weren't sufficient (when they were the SAME records that got me started with NWW and were less than a year old) now...thinking this through, how can a non medical professional such as a CSR determine if my condition as documented is sufficient or not??? Wouldn't that be up to the Dr. or PA to determine? This gets deeper and deeper with issues the more I put my mind to it.
For quite some time I have just been so happy to be free of NWW, but seeing so many people getting a different answer from them every day (or no answer at all!) and having money gone and not getting what they paid for, has riled me up again at the injustices they make people suffer through.
If anyone can answer the questions I have posed regarding who should see your records and who determines whether they are satisfactory or not, I sure would appreciate it.
I hope someone can clear up the privacy issues on this matter - (further though, sorry, I've got my thinking cap on here, ha)... - but in a Dr.'s office, sure there are office staff who can see your records, but I have never heard of that info getting passed around. Now humans being humans, yes a file clerk in a Dr.'s office may tell her friend about some patients condition, but if and when that patient's name get revealed to the public or a condition so rare that it's obvious who in the community one is speaking of, I see a clerk out of a job, a Dr. whos confidentiality agreement with his patients has been breeched and a BIG stink going on with all his patients who are afraid that he talks smack about everyone he sees. In the real world setting (not online) this could cause an entire Dr.'s office to shut down and his license to be revoked depending on the severity of slander the patient has endured.
Whew - this is deep - thanks for reading and responding, I think the isue of our privacy is HUGE and I know the majority here do as well. We do a lot here to insure confidentiality and having an OP that isn't protective of us and our records is a frightening thought.
