I just got fired from my job because my boss found out I was taking prescription painkillers (from my PCP) and I don't know if he can do this or not.
I don't know how he found out...only a trusted few co-workers knew I was taking painkillers (I take Methadone, Valium, and rotate oxycodone and norco for breakthru) but it somehow still leaked to the boss. Now I have been taking this combo for 2 years and could not get up and work without it. They charged me with being intoxicated "impared" they called it. The most messed up thing was that I worked in a hospital (as a lab tech)!!
NO compassion, no medical investigation, just got confronted by my boss one day, got forced into a drug test and an internal investigation and that was it...out the door. My doctor even called my supervisor and told her about my situation ( I have fibro and spondylititis)and informed her I was not a junkie, nor was I impaired. I could function fine and perform all the duties my job required...as long as I had my meds. Well It didn't matter though and I am thinking of suing...but who knows I can't afford a lawyer. But of course I lost my insurance and my med bills are huge!!! So don't tell anyone who dosen't need to know. My idea is that someone may have seem me or looked in my purse and saw a pill bottle or seen me take some meds at lunch. They were just "doing their duty" and reporting me I suppose, but im sure they saw the methadone and assumed heroin addict. I hate nosy people who have to butt into others business in the name of "caring".
If you have good documentation, including from the EEOC, you may be able to get an plaintiff's employment attorney to take your case on contingency. Sounds like it's definitely worth a try. You should at least rattle a sabre to see if they will settle.
