Well, it sounds like to me that cw, your friend should be ok. Since she called in the fake one BUT, then they called to see if "the dr called it in" takes a bit of the weight off.
When you said the Pharm said "we had a problem", and they hung up, that should get them off the hook, this time.
Why??? Well, basically the pharm called the Dr to confirm in which they would have told the pharm "no script was called in from this office" and "who is the patient"?
More than likely the Pharm, in some way, red flagged their name etc etc and knows too look out for them now. The dr. probably has made note in the file in which anytime they make an appt. they know what to do and what to say to them, which would include being reemed out and told never come back.
What is also true is they had to have the script in hand and walking out of the door. It's like that with anything..ie hardcore drugs, hookers etc. If they ever read up on law enforcement or simply watch these "cops" shows, the perp has to not just propose the crime but, be in some kind of exchange ie money...drugs etc.
My advice is NEVER return back to the Pharmacy. IN fact,they should go as far away as possible because this pharm could have very well called the other pharms. If they can go out of state, I suggest that.
To go to a Dr. do the same. The Dr. probably did not call the other Dr's about your friend since they simply do not have the time. But, your friend does not want to red flag themsleves by going to a Dr. in one state, only to get the script filled in another.
So, I think they are in the clear. If they walked out of the door with a bottle filled with the script, then yes they would be SOL. As far as them doing it in other places, the script was filled and paid for. If they have the bottles still, dump them, get rid of them.
Basically, the authorities cannot arrest someone on a "hypothetical intent" No items were exchanged ie Money and script. Even to the Pharm, you could have hung up in anger that the Dr never called it in. The pharm I doubt has caller ID. Plus, they can always convey that someone could have very well called in a script to scam. Your friend called to see if the Dr called in a script because you had a messge on their machine from the Dr's office saying something about a script being called in BUT, the machine is Best if kept off the board, only catching a few sentences.
When your friend called in they covered themselves by saying " I was wondering if the script my Dr supposeldy called in was ready" She did not say " I am calling to see if my script is ready or my script for say Norco is ready"
See what I am saying..no exchange....she only asked if the Dr called in a script and if it was ready...and she hung up abrubtly which could indicate anything ie fustration that someone is playing games or angry that a script was called in without permission from you etcetc
