Honestly, those records are yours, and you are paying the doctor to take the notes and store the records for you-- that's the way I look at it. Please don't be intimidated by haughty office personnel. Also it might be a bit of a wrestling match to get them the first time, but you can do it. I am not up on the new privacy act, but my doctor is great about having the records ready for me to pick up. I probably would not go to him if he did not help in this way, since his policy is to not prescribe heavy pain med either. He sends patients to a pain specialist instead.
