Interesting email I recieved from Clay Fuchs today

Looks like Clay is in some pretty serious trouble, here's the e-mail I recieved on 2-11. I don't think I want to give my name and e-mail address to be used in Federal Court. What do you guys think?? I used Nations Pharmacy one time before they shut down. It was a no questions asked, no consult situation. Similar to E-RX before they got wise and started consulting. Here's the e-mail, Check it out...

If we lose, then the government has taken a giant leap in defeating online prescribing and online pharmacies altogether. If you are interested in helping us win our case and preserve your right to obtain information, medical advice, and receive prescription medication online, please give us a testimonial. Please be as descriptive as possible.

1. Please describe the condition that you have that prompted you to go online to receive your prescription medication. Also, describe how the use of an online pharmacy has helped you to receive your prescription.

2. Tell us if you have received the medication previously and you simply wanted an easier way to receive refills of the medication(s) that you need.

I rec'd the same e-mail today as well and don't remember using any of those OP's in the past...hmmmm? Then I rec'd a "corrected" e-mail with essentially the same information except the reply addy was changed.
Personally, I wouldn't give my information away. Somehow, someway, they got my e-mail addy (hope no one is selling e-mail addys).
No response from me - that's for sure

Hi..I too got three emails from them..I did use both of there pharmacys...it really bothers me cause now my name is on a list ...they are closing in... sucks...Boo..

I sent the guy a some encouragement.I use a hotmail account I never used them ,I signed up, but never used them.If I can help them though, I will.I don't think it is as bad as it could be.I have heard that some of these OP's may be facing federal civil litigation.They are trying to line up a bunch of online character witnesses to show the good they do vs a few who think they do bad.There was case I am trying to remember where some Dr.said in a pain mgt. trial that hydro was for the terminally ill (an idiot) only.He was discredited, but sued someone for slander. I gotta look this up.I know one was in S.C.

I was wrong abouut civil that is another guy.Legitimate has posted what is going on with Mr.Fuchs in another posting.You are right Beetlenut his lawyers are wanting just that.Keep him out of the pokey.Here is the story:

DALLAS (AP) -- Three physicians, two pharmacists and
another man
have been indicted on charges alleging they conspired
to illegally
distribute the painkiller hydrocodone through a
Web-based pharmacy
operation, the U.S. Attorney's office said Tuesday.
The physicians never had face-to-face contact with
the customers
for whom the prescriptions were written, the indictment
unsealed
Tuesday said.
Pharmacist Clayton Fuchs, 32, was arrested Tuesday
at his home
in Rockwall and was charged with one count of
conspiracy to
distribute a controlled substance, one count of a
continuing
criminal enterprise and one count of money laundering,
officials
said.
If convicted, he faces a statutory maximum sentence
of life
imprisonment and a $2.5 million fine.
Also arrested Tuesday was Fuchs' stepfather, Eugene
Gonzales,
48, of Garland. He was charged with one count of money
laundering
and faces a maximum 20-year imprisonment and a $250,000
fine, if
convicted.
Pharmacist Waldrick Lemons, 29, of Desoto and
physician Kenneth
Speak, 76, were charged with one count each of
conspiracy to
distribute a controlled substance. If convicted, they
face a
maximum of five years in prison and a $250,000 fine.
Speak
practices in Dallas, authorities said.
Physicians Stephen Thompson, 49, of Garland and
Robert Ogle, 55,
of Rockwall were each charged with one count of
conspiracy to
distribute a controlled substance and one count of money
laundering.
If convicted, they face statutory maximum sentences
of 25 years,
and a $500,000 fine.
Officials say they expect Lemons, Speak, Thompson
and Ogle to
surrender later this week.
According to the indictment, Fuchs operated Friendly
Pharmacy
and Main Street Pharmacy, businesses that both had
Web-based
operations.
Prosecutors say both pharmacies solicited customers
through
their Web sites. From Jan. 1, 2000, to March 31, 2001,
Thompson,
Speak and Ogle allegedly prescribed controlled
substances,
including hydrocodone, for customers who lived
throughout the
United States.
"The pharmacies, through Clayton Fuchs, Waldrick
Lemons and
other pharmacists, knowingly filled and dispensed
controlled
substances on the basis of Internet prescriptions
approved by
Stephen Thompson, Kenneth Speak, Robert Ogle and Ricky
Nelson,"
the U.S. Attorney's news release said.
Nelson is an Oklahoma City physician who was
convicted in
January of prescribing addictive narcotics over the
Internet.
Fuchs allegedly controlled all the incoming money,
and
determined what payments the participants in the scheme
would
receive, prosecutors said.
Fuchs and Gonzales made an initial appearance in
front of a
federal magistrate Tuesday.
Hydrocodone is a powerful painkiller found in
prescription drugs
such as Vicodin and Lortab.
According to the Texas Lieutenant Governor's office,
hydrocodone
is one of the most abused drugs in the country. In
Texas, it is one
of the top drugs stolen from pharmacies or diverted to
illegal use.
