Man Heads To Prison For Running Online Pharmacy Illegally
Judge Orders Forfeiture Of Nearly $900K In Assets

POSTED: 3:39 pm PST January 21, 2005

SAN DIEGO -- A man whose local company ran an online pharmacy with 60,000 customers was sentenced on Friday to more than four years in prison on a host of charges, including conspiracy to sell counterfeit pharmaceuticals.

World Express Rx owner Mark Anthony Kolowich, 45, pleaded guilty to conspiracy to sell counterfeit pharmaceuticals, conspiracy to launder money and conspiracy to commit mail fraud and smuggle pharmaceuticals.

Customers at World Express Rx believed they could buy such drugs as Viagra by paying for them in addition to a $35 "doctor's fee." The Web site, in fact, had no doctor working it.

During court proceedings, Judge Jeffrey Miller described Kolowich as the "architect" and "kingpin" of a criminal prescription-drug organization that hired "drug mules" to bring pharmaceuticals into U.S. at the border crossing in San Ysidro.

While he was imposing the sentence, Miller told Kolowich that "there's an old saying: 'You need to put the pill where the pain is.' "

Besides sentencing Kolowich to 51 months in prison, Miller ordered Kolowich to turn over about $900,000 in assets.

The World Express Rx case is one of the biggest Internet pharmacy prosecutions ever, said U.S. Attorney Carol Lam.

"The simple fact is that when people use the Internet to obtain prescription drugs, they take a risk because the drugs might not be what they appear to be," said Lam. "Consumers need to be aware that many of the safeguards that exist for bricks-and-mortar pharmacies do not exist for Internet pharmacies."

World RX manufactured "generic" versions of Viagra, Cialis, Levitra, Propecia, Celebrex and Xenical in Mexico with the active ingredients of those pharmaceutical drugs, then smuggled them into the U.S., according to prosecutors

It goes to rxmex if anyone is curious and doesn't want to click on the link. Apparently they purchased the world express domain, which is a pretty common thing to do when a popular website is shut down.
