Stolen Meds! - Legal Question.....

Hey Everyone,

My screw-up nephew was over last weekend and stole a bunch of stuff, including my meds, even my non-prescription stuff!?!...

Now I'm up a creek and in pain. Here is my question:

I recently changed OP's, and I need to know the legal ramifications (if any) that would arise if I went back to my old OP and requested a refill? Any ideas?

how long has it been since ordered?
also i think that nephew of yours needs to spend some time in the cage.let him suffer for awhile.i hope the best for you.if its been more than 25-30 days you can reorder.

If you have been prescribed a med in the last 30 days and you order another one, that could be considered as double dipping, however I think most would do that in your position.

The other solution would be to file a police report and then go back to the prescribing doctor and see if they will issue another script.

Yeah, he's a real winner (NOT)

I've done what I can already to punish him, but if I file a police report it'll only cause more trouble for my brother, etc., blah, blah, blah. Where's my violin......

As far as my ordering, it's only been about 18 days. Do the OP's really check with each other that closely? Maybe they do, and should, for that matter, but I'm just asking because I don't know.

Who was your OP last time? Some, if you send them a police report, will replace them. I think that's your safest bet, but the "double dipping" option, while I wouldn't recomend it, is also an option.

Thanks, sorry to hear about this. I have had a room mate steal mine twice in the past. First time I couldn't prove it. The second time I replaced the pills with duratuss (decongestant). Crazy enough, after that bottle dissappeared, my room mate was sniffing a whole bunch. Hmmm...

i have doubled a few times but really you should not suffer for him.he doesnt care for you suffering so i think he will get what he deserves in jail.if some of the stories are true what i hear happens to newbies in there.
hey why not go with a no records op.skyrx is fairly decent in price for no records and i know you will never get caught for dbldip. from there.last i used them there was no label telling the pharmacy or doc,just the name of the meds.

does your brother know what's going on??? if he doesn't don't you think he should? be easier coming from his sister than from the police station later on.

if he does know about this, does he care? if he does care, why isn't he getting his son some help? letting him get away with stealing is doing him more incalculable harm than good. not to mention what looks to me like the beginning of a serious drug problem. legal problems could be the least of his worries. he could wind up dead (or hurting someone else, sort of like what he's putting you through making you suffer like this).

if your brother doesn't care about his son, i am sure that you do. i can tell that you love your nephew by the fact that you want to protect him. sometimes the most difficult decision to make is the right one. i cannot tell you what to do, i'm not even sure what i would do myself in a similar circumstance, but i do believe this should be nipped in the bud before it's too late. i am really very sorry that you have to go through this. i will keep you in my prayers.

as for replacement rx, i don't know what to tell you without a police report showing that your meds were stolen. maybe try an iop? at least for now....

I also think the little weasel should be turned into the cops. You are NOT doing him any favors by not confronting this right now.

He will continue to pull more & more dangerous stunts until he suffers some very serious consequences. Just my .02

In a situation like that, when you were robbed, I guess you should probably order a refill, but you should get a police report on the stolen meds, just in case it ever does come up.

I'm curious though, I didn't realize that you could switch OPs while there were refills left. It doesn't matter, as I'm really happy with my OP, but when I was first shopping around to find the best records OP, I was real careful about picking one because I thought I'd be stuck with them for at three months. I didn't realize that you could switch without cancelling the previous refills.

I'm so sorry that your nephew did that. You need to buy one of those closet safes (the kind you drill into the floor of your closet) and hide the meds in the future or keep them with you constantly. If he is addicted, he may know when you go out and try to get them again.

Unless you turn him in (and be prepared to prove it), you have little or no hope of getting replacement meds earlier than your refill date.
I wouldn't want to be in your position (in regards to your family). That might end up being tougher than the w/d.
If it were me, I would contact my brother. Give him a chance to correct the problem (which might not include more meds). If he didn't, I would proceed myself.

If you do not get a police report, you do not get an early refill.

If you double dip, you take the chance of getting caught, and a lot of people are getting caught these days. Then you end up blacklisted by both of those OP's and any other that they may be affilated with.

How much are you going to let your nephew take from you? If you will not file the police report, you should not double dip. It is not worth it.

Also consider that the more people that get caught double dipping, the more ammo the DEA gets to shut them all down.

Please don't do it.

My house was broken into while we were out of town last week-end, all prescription meds were taken along with personal items..mostly jewelry...We called the police, it took 3 days to get a copy of the report, I called my pcp and faxed him a copy of this report... he still has not phoned the pharmacy to refill my meds.....It's been over 3 days since I had ANYTHING and I am really feeling bad.....I phoned a "hot line" and was told the doctor had a legal obligation to treat me as long as I had complied with his request (faxed the report)...Does anyone know if this is correct? I will probably have to go the ER if he doesn't come through........Hope

As far as the little $hit goes, yes, my brother does know what happened, and at this point, even he is suggesting that I file a report. My brother has also offered to pay me for what was taken. I'm still stewing on it...BUT,

LOOKS LIKE MY (AND SOME OTHER'S) PLAN WORKED

well, i am glad that you are working things out and getting your meds tomorrow. sounds like you have a great relationship with your brother, which leads me to believe that there is hope for your nephew. as soon as your immediate needs are met, i suggest you get some help for him, the sooner the better. seems to me, you have a great, caring family and this would prove an invaluable asset concerning the welfare of your nephew. i have no doubt you will make an excellent support system for him, but you have to, HAVE to be firm. good luck to you, sweetie.
