Florida Senate Bill sb1372er - Ordered into law 07/01/2004
Florida Pharmacies desiring to do business over the internet must acquire state permits by 07/01/04. Could all with legal background please interpret the ramifications?
Any person desiring a permit to operate a special pharmacy which does not shall apply to the department for a special pharmacy permit.

This section is especially troubling:
(1) The following acts constitute grounds for denial
of a license or disciplinary action, as specified in s.
456.072(2):
(s) Dispensing any medicinal drug based upon a
communication that purports to be a prescription as defined by
s. 465.003(14) or s. 893.02(20) when the pharmacist knows or
has reason to believe that the purported prescription is not
based upon a valid practitioner-patient relationship,
including appropriate patient history and a face-to-face or
visual encounter by the practitioner.

and this has passed in the Florida Senate, due to take effect on 07/01/04. Looks like it means drugstore.com can still dispense..... what about the others?

I never understood why there were so many OPs working out of Florida. Maybe that has something to do with this new law. Having so many brought more attention to them.
I don't know which OPs and/or pharmacies that do NOT work from Florida, but know there are a few from reading this board, but can't remember which ones.
I wonder how they'll fair now, when this bill goes into effect.

I only post the same thing in two places when I feel it is something of vital importance that threatens Telemedicine and want the entire audience to see it.
[start sarcasm] Turns out, unless it involves a bust, a thread down in "Media" gets 500 views, where one about hotdeals COD policy will get 5500 views up in "Open Discussion" [end sarcasm]
In any case, a poster in "Open Discussion" read the bill today and noted the following:

Apparently, the bill was edited prior to final approval. I attempted to speculate on what that might mean in the "Open Discussion" area

I's bet all pharmacies getting a "special" permit get audited more often. Just speculation. Interesting.
