Just received an email informing customers/patients that they were discontinuing their service. Says any charge backs would be investigated on an case by case basis, and that any fraudulent charge backs would cause the cardholder a great many problems. Nice of them to include a threat with the announcement of their going out of business.

I also got one from an order that I placed and never received in mid August. I called my credit card company last night and filed a dispute against them, so I thought the email message was individually addressed to me until I read it a little closer.

I hate to be threatened and while I don't have a lot of time, it will be my life's mission to keep following up on this until I get a COMPLETE refund from them. All I can say is BRING IT ON!!!

An the same note, I have a friend who works for one of the big three CC processing clearinghouses. He stated that every time a charge back is initiated against a company and it is proven that they did not refund in a timely manner, they are fined somewhere in the neighborhood of $10K. I can only hope and keep my fingers crossed that they'll rack up lots of these fines for their behavior over the past couple of months.

I guess I can see where some people would try and scam ERX (yes they deserve it) by filing a false chargeback knowing they got their meds. Probably jsut a few would do that as most of us are not like that.

Does anyone know what happens if a company like ERX has no funds available for a charge back? Does the credit card company eat the loss or does the consumer?

That's one reason why I don't like paypal is because if the seller has no money, we lose, end of story and if you do a CC chrageback, paypal unleashes their wrath upon you.

I believe fed law is if you pay for merchandise with a CC and don't receive it your only liable for the first $50. Unless of course you have the Capital One no-hassle card.

I'm guessing if I paid the consult fee and received refills I can't get a pro-rata refund on the consult fee.
I was due a refill a couple of months ago and am not sure if I'm lucky I kist nothing or upset that I lost me refills...

went to refill and wanted it shipped next day, no ups but cc was charged called and spoke with live person, she informed me i didnt have no refills asked well what about my cc, she said that it would take them 2 weeks to put the funds back on, called my cc holder capital one might add and told me the merchant has 30 days to send merchandise if not then i can do something about it. got to wait wait wait that really bites the bullet, they shouldnt take money until the merchandise is in the mail, like some other places.

I got the same email, but I don't know why. I never used them EVER! NOT EVEN ONCE! Anyone else share this experience?

Sorry this is not true. Merchants are fined about 25.00 per chargeback. This varies with the processor though.
If the merchant gets enough chargeback requests, they lose their merhcant account. The money is given back to the customer from the customer's issuing bank. The issuing bank then bills the processor. The processor then goes after the merchant by taking out funds owed plus the chargeback fee. If the merchant has no money in their account to pay for the chargeback, then the bank that holds the funds that the merchant uses to deposit their sales, can close the account. Then the processor can sue the merchant for the money.
In the end, it is the merchant that is responsible. Customers never lose because they are reimbursed from the card issuing bank.

Buey is right, it is no where close to 10k. I think our revenge factor would like that (which in turn makes it more believable for some), but that is defiantly not true.

You have to remember that the businesses that use Visa are there customers too. They pay the fees that are associated with using visa and Amx.
