It looks like Florida has come up with a law that prohibits doctors from prescribing on the basis of a questionnaire alone.

If you look at #3 in the above article, there is a provision for emergency doctor-patient relationships. I have no idea how that's going to be applied in practice, though. I sure hope the Florida OP's can adapt!

I just have a question because I'm not up to date on political type wordings, but this "law" is called the "telemedicine rule" does a rule have the same value as a law? If is it is broken is it illegal or is just not a appropriate action??? I'm just wondering....Any clarification would be helpful. Thanks.

It appears to ME that this law went into effect 9-14-03 so quite possibly we haven't seen the ripple effect?

Does anybody (in the field) have further input as to how this will impact non-controlled drug sites that sell anything from Ultram or Viagra, to sites that sell controlled drugs such as Ambien or Didrex (for example?)

It would appear that sites that rely solely on an online questionaire are in violation of the law in FL.

I think the places that request records, and have a phone consultation meet the requirements of what I read in the second link.

It looks like the Viagra, phentermine, and some of the other no records no physician contact places do not meet the requirements, but I am no lawyer.
