Lovelace case sent back to grand jury

(Chandler-AP) -- The case involving a former Chandler police officer who fatally shot a woman has been sent back to the grand jury.

The case was overturned today in Maricopa County Superior Court.

Dan Lovelace was indicted by the grand jury in November on one count of second-degree murder in the October shooting death of 35-year-old Dawn Rae Nelson.

Police reports show the shooting occurred after Nelson drove away from Lovelace as he questioned her about a fraudulent prescription at a drugstore.

After the court's decision today, Lovelace said everything he has done and worked for has been ruined. He said this is a tragedy for him, his family and his co-workers.

Lovelace's attorney -- Craig Mehrens -- says they hope that with additional evidence there will be a different verdict.

If vindicated, Lovelace says he wants to return to police work because he has a duty to serve the public.

Yeah, isn't it pretty much a tragedy for the woman he blew away and her kid too?
