For example, a cop pulls you over for speeding or other violation. The cop can usually smell liquor on a person and then do this procedure to test for driving over the limit. Prety clear cut, right?

But short of searching a person or their vehicle (assuming that you had medicated yourself before getting into the vehicle and you did not have any meds on you or in your car) and you are not acting or driving erratic , how can a person be arrested for DUI?

I am just curious because Texas has instituted a 'points system' and the state is now gearing up to start collecting for tickets or arrests for DUI soon. A first time DUI just for the points I think is $1000.00. This is not the other bad stuf that goes with DUI.

I remember when it was just DWI. Times were simpler then. I guess now its the LE thing to do is to throw drugs into the mix and call it driving under the influence DUI. What I am saying is that short of a crack pipe or joint lying on the car seat and you left your perscription meds and tranqualizers or muscle relaxers, etc at home, how COULD you get arrested on perscription medication that you might have taken thinking that you have always been completely fuctional with your usual dose but perhaps you get a pill that had a little more of the narcotic ingrediant than usual ( and that happends to me every now and then or I get a stronger batch of meds) and you were UNINTENTIONALLY feeling more pain free than normal when you get pulled over.

I tried to make this articulate but with this post (and probably others) I may have lost the readers-sorry once again.

But I would really like to know under 'normal 'circumstances, wouldn't it be pretty difficult to prove that you wre under the influence of medication?

Also, what do you do when you have to carry your medication with you like on a day trip and get stopped. The cops practically search every vehicle they stop along the highway I live by at night (like they did with this guy last night).

The bottom line is suffer thoughout the day or night or risk taking the medication that might get you a DUI.
