I got out of the car and put my hands behind my back. I was guilty, knew it and admitted it, didn't hire an attorney and pled guilty in court. The second: I was convicted of for refusing the breath test. I passed the roadside tests on that one. However NC state law made it an automatic conviction for refusing the breath test. I had 2 drinks, shots. I hired who I thought was a good attorney, but it was out of state and all out conversations were phone consults. He sucked in court and basically said he could do nothing because I refused the test. I have drank exactly 3 times since then. With the third being this time. Before my arrest in 2002 I was a heavy weekend drinker. Will I ever drink again? Don't know. Will I ever drink again and drive a car. Probably not. BUT this is the way the lawyer put it to me. Who I am hoping is a good lawyer. He did cost me nine grand. The fact that my breath test was two hours after beign pulled, and the fact that I was pulled right after drinking, does lead to the conclusion that the breathalyzer test was not what I was driving at. The prosecutor has to prove that my BAC was .12 WHEN I was pulled over. SInce the alcohol I had drank had not had time to digest and enter the blood stream, I would liekly have been home before it went over .10. After drinking your BAC will rise for 2 hours or so(depending on metabalism and food, etc,) and Then begin falling. Okay now to the point. Was I wrong? Yes. Did I make a huge mistake? Yes. I didn't realize that I was shirking responsibity in the boards eyes for what I had done. I was scared and had charges that I didn't know I could be charged with in additioin. Oh...also for the record....the Xanax...was in blister packs. The cops asked me what the blue pills were, I assumed they meant the Xanax, since I already told them I had a script for the lortab 10/500's (which are blue). When I retrieved my belongings from jail, the xanax were in there. SO the meds they sent out to be analyzed are going to come back as hydro, which I have a prescription for. AND also for the record, I requested both an attorney and a blood test to prove I did not have hydro or Xanax in my system. I got niether. In fact they refused me a phone call for 12 hours as well. Furthermore......I have not had a hydro since noon on Sunday. So going on 60 hours hydro free. |
