So many people fail to utilize their RIGHT TO REMAIN SILENT! Never, never, never talk to the cops after an arrest. It is NEVER in your best interests to do so. You were legally drunk, night blindness (my dad tried that excuse, too, on his 3rd DWI/DUI and it was laughed out of court) has nothing to do with it. I believe they could have charged you with DUI as well seeing as you had medications out of their containers and without prescriptions. I concur with everyone else here...GET AN ATTORNEY! FAST! I don't know about the laws in your state, but DWI is a felony in Minnesota and now carried mandatory minimums on multiple offenses, including suspension of driving priveleges. I am NOT condemning you. I'm only pointing out this stuff from an uniterested party's point of view. It will be very hard to convince a jury of "innocence" or "night blindness." The judge may ask you the same thing he asked my dad "if you are night blind, why were you driving at night and under the influence of alcohol/drugs?" Good question! Good luck! |
