I am a paralegal but not an attorney so advice should be followed up by an appointmnet with an excellent attorney asap.

First of all a police officer can search your vehicle anytime if you are pulled over for whatever reason. Your vehicle is not like your home they do not need a search warrant or your permission to search. When you are caught drinking and driving it is pretty likely they will search your vehicle for drugs.

Anytime you are being questioned for whatever reason by a police officer you should remain silent until you speak to your attorney. If you are being pulled over the police officer is NOT your friend even though they may make it seem like it is in your best interest to talk, more than likely you should keep your mouth shut. You are only providing them with more evidence, which I am sure you realize now!

IF you have a really great attorney he will try to have the possesion charges dropped with the script of the hydro and I would get a script for the xanax and get the medical records showing you have previously been prescribed the medication. He may try to have the DUI charge reduced to a wrecklass driving charge, but more than likly you will need to plea guilty to the DUI charge for the DA to even think about dropping the other charges. Then you will probably need to agree to go to a Drug rehab center( you can sometimes go to an outpatient center, but it is less effective in my opion.) You will lose your license for a year I think it is not sure what state you are in, and may have to take a defensive driving course before getting it back and be on probation for a year. In most states it is manadorty that you spend at least 24 hrs. in jail and they do count time served so in your case you have about 12 hrs left to serve. You are able to pick a day to serve your time out.

I hate to say it but this is pretty much the best case scenario. They do not play around with driving under the influence anymore you are very lucky that you did just get pulled over. I had a friend in high school that was drinking and driving and going down the wrong side of the interstate (not with me) and she hit a car with a father and his 2 children in the car and killed them all. I know that is not what you want to here, but be very glad this did not happen to you, you being pulled over before you hurt yourself or others is the best thing. And when you are drinking and taking those meds you listed you are not in any condition to be driving a car. I am not blasting you for it, I have driven too when I know I should not have. It is just not worth the trouble you are facing, and I hate to see anyone in your situation. It does seem like you are willing to get the help you may need, which is a really good thing.
