I'm a Libertarian who believes that what people do in the privacy of their own homes is nobody's business unless they hurt someone. Well, driving drunk on a public road and corssing over the center line is endangering everyone and i think the crime should be prosecuted vigorously. Especially on a third offense!

The only good news is that you didn't hurt anyone but yourself, so far. If you're convicted of several felonies and go to prison, they can take your children if there's no relative who is willing and able to be their guardian.

0.12% is driving drunk and if the illegally possessed Xanax shows up too on a tox screen, you're totally sunk. If they arrested you for good probable cause (as it seems), the search that found the Xanax is probably legal and they can charge you with illegal possession, which may or may not be a felony depending on state law. You also admitted taking too much hydrocodone. All of that will be used to make this an open and shut case. Prison time is a good possibility. If i were in that situation, i'd do anything to stay out of prison.

If they caught you driving drunk three times, odds are that you've done it a lot, no matter what. You're facing the loss of tens of thousands of dollars to pay a lawyer who might not be able to keep you from going to prison and losing your van. Most states have tough penalties for a third DUI conviction and state law may very well allow them to seize your vehicle. Confessing to the additional drug charges and the possession of two driver's licenses seems to indicate that you'll almost surely get convicted of a felony and serve prison time for it. Probably the only thing worse would be vehicular manslaughter, if your drunk driving had killed someone.

PEOPLE! When they read someone the Miranda Warning, they mean it. If you don't "lawyer up" and go on and on describing your crimes, you're digging your own grave. I personally think that because DWI kills so many innocent people, the laws should be as harsh as possible. If someone is kept in prison they won't be hurting others by driving drunk. I also think they shouldn't wait for the third conviction to seize the vehicle.

Advice? You ought to use all your savings and borrowing power to get the best criminal defense lawyer you can find. Hopefully, losing all that money will keep this from happening again and will get you into some kind of rehab that keeps you drug and alcohol free, even if you're acquitted, since you seem to have a problem that's endangering public safety. Getting Bupe to try to overcome a hydro problem seems to be addressing just a small part of the problem. Some people need to stay away from drugs and alcohol completely because they can't handle it. If you can get away with this, i hope you stay "clean" and go to AA or NA meetings for the rest of your life. The world will be a safer place for it. Sorry to sound so harsh, but repeat drunk drivers get my goat. What right do they have to jeopardize my life?
