I don't know if it's "legal" exactly, but I believe it's a lesser offense than a "known" controlled substance. And then there's that ever-present sticky issue of them having to spend the time, money & manpower in and out of court trying to prove to the judge that you ordered 90 bromazepam or whatever the non-scheduled drug is.
