Dasani - I think you're vastly overstating what a prosecutor has/needs to get an indictment. An indictment from a Grand Jury requires far less evidence than is required to convict. Defense attornies are generally not even allowed in a Grand Jury proceeding. The GJ hears only what the prosecutor wants them to hear.

IMO -KO is in the clear now.

BTW - Wiping (e.g. with Norton Utility) a hard drive is an excellent idea, if you think a search warrant is about to be executed on you. Such wipes will usually prevent resurrection of any data by any but the most sophisticated LEO's. Yes, the NSA might be able to pull the data out of the noise with one of their 'sea of FPGA' devices, but how often do you think the NSA gets involved in drug case? I'd guess never.
