It suprises me that any of you think that the federal government is JUST or FAIR or that the law REALLY applies in many cases! Without being inflammatory (but experiencing the incredibly UNJUST railroad of federal prosecution right now,) it needs to be said that federal judges are laws unto themselves. They do not have to stick to sentencing guidelines and they have broad and far-reaching jurisdiction (especially using the "interstate commerce" clause--making it a federal crime if a piece of equipment like a camera or the film therein made in Pennsylvania is used to commit a crime in Arizona.) And the federal government can prosecute somebody EVEN THOUGH THEY HAVE ALREADY BEEN PROSECUTED BY THE STATE FOR THE SAME CHARGE. And how about this one...I went to court to challenge a search warrant and the SAME JUDGE WHO SIGNED THE SW was presiding and didn't feel it was inappropriate for him to rule on the contested SW!!! Of course, he did not suppress the SW! Don't take anything for granted. The feds can get away with pretty much anything they want without fear of legal ramifications...and the expense of fighting them STARTS at $5,000 and can exceed hundreds of thousands. |
