I agree with Hoss on this one. When cops ask if you have anything they should know about ... they mean weapons or anything illegal ... like a gun, knife, or MJ joint. Telling him about the Xanax could have been interpreted as you saying it was illegally possessed. If so, they could flush the pills just like they can stomp a joint into the weeds by the side of the road. You probably would have been better off not mentioning it. If they found the bottle on your person before locking you in a cell, you could explain that you needed to take it according to the directions on the bottle. If you had just silently left it in the car it probably would have been a total non-issue. It came from a pharmacy that's DEA licensed and had your name on it, right? That makes it legal to possess. If you're put in lockup they could rightfully keep the bottle of pills to prevent diversion or an overdose but you should have been able to get a dose if you told them it's medically necessary. Someone could get awarded substantial damages if they were epileptic and had a grand mal seizure because the cops willfully withheld their medication. Trampy |
