However, have I an MRI report, clearly, a physical exam has ben performed by a doctor. Where does it state the prescribing doctor must be the one who performed the physical exam? Show me a court case where the judge interpreted it this way. As far as the established doctor/patient relationship, it also once again for judge interpretation what that exactly means. I believe what you all say about too many rx's though. I think fishdude is accurate. They are going after the doc's too often these days. Its interesting though, a lot of these op shutdowns are at the pharmacy board or civil level, and criminal charges are not brought. It is being attempted to pose this question to someone on a pharmacy board at the state level to see what they think. Does the number of percocets sold really flag that much brighter than the number of lortabs sold? What are the differences in record keeping and reporting between CII's and CIII's I wonder. I hear, to a certain extent, its up to pharmaceutical wholesalers to note 'suspicious' amounts of controlled substances being ordered. We should look at the actual number of hydro vs oxy rx's there are to know at what number the flags would start, relatively. IMSUSCOT: I have read several cases of an op shut down I can find. In every case, there was clearly gross negligence on the doctor's and/or pharmacy's part. One of those places 'lost' 1.2 million hydrocodone doses. They don't keep proper records and give out imprudent number of rx's to the same person, overfill orders, serve minors, or something else ridiculous. Dr. Dom was writing AND filling the scrips, totally illegal for him to do. I haven't seen one totally legit OP go down to my knowledge. I'm not an old hat though, so I've got a lot to learn from you all. It just seems like those that 'are dropping like flies' are the ones that are ran by people using the Best if kept off the board drugs they're offering. |
