Doctor-patient relationship is not fully established without a physical exam by the physician or medical professional reporting to the prescribing physician. Telemedicine is operating in a grey area, actually more like "haven't been targeted for verbose interpretation of federal statute". Portamedics appear to be a way to satisfy any future problems with this grey area, however, what others said about the physician getting arrested for prescribing too many CII's is absolutely true. Not to discourage but I would say your friend is really putting himself in serious jeapordy of being arrested by prescribing CII's remotely, EVEN with a portamedic. It seems inevitable even. The statute citing the definition of doctor-patient relationship as a physical one is elsewhere on this site. |
