Fedex wouldn't be federal,I believe federal would only cover government institutions such as the USPS.I was always under the impression that Fedex IS legally covered to open anything that is in their possession for different reasons. All they would haveto say is checking for dangerous substances etc.. I remember a few years back may be 5 yrs. ago when we could actually get Fedex overnight delivery from Pharmagroup I think in Spain? and Fedex opened a couple of my pkgs. and then not long after Pharmagroup had to quit delivering that way all together.God,those were the days!!!!

The 4th Amendment only covers actions by government agents. FedEx is private, not government. FedEx and all private carriers can open up any package they want. They don't need a reason and they certainly don't need a search warrant as is usually the case with USPS.

If FedEx finds what they believe are illegal drugs they can call the police and hand it over to them to make a legal bust. Read the standard terms on their shipper. When you hand a package over to them you are authorizing them to inspect it.

If you want more privacy, use USPS Priority Mail or Express Mail. Unless the package is undeliverable or leaking or something like that, they need a search warrant based on probable cause to open a mailed package.

If you go to FedEx in the Phillipines or Mexico to send off a package, they routinely open it up right at the counter to see what's inside before accepting it.
